Terms and Conditions of Use

for the website www.dynamilab.com and the Dynami mobile application.

1. About Dynami Srl

Dynami Srl (hereinafter "Dynami" or the "Company"), with registered office at Via Montello 47, Italian Tax Code and VAT number IT05962330873, registered with the Companies Register of Catania under no. 05962330873, owns and operates the website www.dynamilab.com (hereinafter the "Site") and the mobile application "Dynami" (hereinafter the "App"), through which it provides sports and wellness services in Italy.

2. Subject Matter and Scope

These General Terms of Use (hereinafter the "Terms") govern access to and use of the Site and the App by any user (hereinafter the "User"). Accessing the Site and installing the App require the reading, understanding, and full acceptance of these Terms. Users who do not intend to accept them are invited not to use the Site or download the App.

These Terms apply to all Users, whether natural persons or legal entities, and supplement — without replacing — any specific agreements entered into between the User and Dynami for the provision of particular sports services or memberships.

The App can be downloaded free of charge through the available digital stores (Apple App Store and Google Play Store) for installation on mobile devices (smartphones and tablets). Dynami reserves the right to update the App periodically.

3. Registration and User Account

3.1 Account creation

To access the reserved services of the Site and the App, the User must register and create a personal account (hereinafter the "Account"), providing the requested data in a truthful, complete, and up-to-date manner. The User is responsible for the truthfulness and accuracy of the information provided at registration.

Completing the registration entails acceptance of these Terms and of Dynami's Privacy Notice.

3.2 Access credentials

The User shall diligently safeguard their access credentials (username and password) and shall not transfer or communicate them to third parties. In the event of unauthorised access to the Account or of suspected compromise of credentials, the User shall immediately inform Dynami at support@dynamilab.com .

Dynami shall not be liable for any damage arising from unauthorised use of the Account by third parties where such use is attributable to the User's failure to safeguard their credentials.

3.3 Account suspension and deletion

Dynami reserves the right to suspend or delete the User's Account, with or without prior notice in cases of urgency, in the following cases:

  • Breach of these Terms
  • Fraudulent or unlawful use of the Site or the App
  • Provision of false or misleading information at registration
  • Conduct that may cause harm to Dynami, other Users, or third parties

The User may request the deletion of their Account at any time by sending a written request to support@dynamilab.com , without prejudice to Dynami's right to retain data within the limits set out by applicable law and by the Privacy Notice.

4. Services Offered

4.1 Site services

Through the Site, the User may access the following services, some of which are reserved for registered users:

  • Browse the catalogue of sports services and membership plans offered by Dynami
  • Purchase memberships and sports services via the e-commerce section
  • Book lessons, classes, and personal training sessions
  • Access the reserved area with purchase history, invoices, and documents
  • Send requests for information and support
  • Receive news and updates on Dynami services

4.2 App services

Through the App, upon registration and creation of the Account, the User may access the following services:

  • View timetables and details of available lessons and classes
  • Book and manage training sessions
  • Track sports activities and personal progress
  • Access personalised training programmes
  • Locate the nearest Dynami facilities (subject to geolocation consent)
  • GPS tracking of outdoor routes (subject to consent)
  • Receive push notifications about bookings, offers, and updates
  • Access the e-commerce section to purchase memberships and services

Dynami reserves the right to modify, expand, or reduce the services available on the Site and the App at any time, giving Users reasonable prior notice where possible.

5. Purchases and Payments

5.1 Service purchases

The purchase of memberships and sports services through the Site or the App is subject to the specific conditions indicated at the time of purchase. Before proceeding, the User is invited to carefully read the characteristics of the service, the price, duration, and renewal terms.

The order is finalised upon the User's purchase confirmation and the corresponding payment. Dynami will send the User an order confirmation to the registered email address.

5.2 Prices and VAT

The prices of the services shown on the Site and the App are expressed in Euro and include VAT pursuant to applicable law, unless otherwise indicated. Dynami reserves the right to change prices at any time, with the understanding that changes do not apply to orders already finalised.

5.3 Payment methods

Dynami accepts the following payment methods:

  • Credit/debit card (Visa, MasterCard)
  • PayPal
  • Bank transfer (for selected purchases)
  • Other methods indicated on the Site at the time of purchase

Online payments are handled by PCI DSS-certified providers. Dynami does not store Users' payment card data.

5.4 Right of withdrawal

Pursuant to Italian Legislative Decree 206/2005 (Consumer Code) and EU Directive 2011/83/EU, the consumer User has the right to withdraw from the contract within 14 (fourteen) days from the date of subscription to the membership or purchase of the service, without any obligation to provide a reason. Withdrawal must be communicated to Dynami via:

The right of withdrawal does not apply to services fully performed before the expiry of the withdrawal period where the User has expressly waived the right of withdrawal and has acknowledged it in accordance with Art. 59(1)(a) of Italian Legislative Decree 206/2005.

6. Intellectual Property

All content on the Site and the App — including, by way of example, texts, images, photographs, videos, logos, trademarks, graphics, source code, software — is the exclusive property of Dynami Srl or of the respective rightsholders and is protected by Italian and international copyright and intellectual property law (Italian Law 633/1941 and Legislative Decree 30/2005).

It is prohibited to reproduce, distribute, modify, translate, transmit, publish, or otherwise use the content of the Site and the App without Dynami's prior written authorisation, except for strictly personal and non-commercial use.

7. User Obligations and Liability

The User undertakes to use the Site and the App in compliance with the law, these Terms, good faith, and third-party rights. In particular, it is prohibited to:

  • Use the Site or the App for unlawful or fraudulent purposes, or in violation of third-party rights
  • Transmit or publish defamatory, obscene, offensive, illegal content, or content harmful to others' privacy
  • Attempt to gain unauthorised access to Dynami's or third-party computer systems
  • Use bots, spiders, scrapers, or other automated tools to gather information from the Site or the App without authorisation
  • Interfere with the proper operation of the Site, the App, or Dynami's systems
  • Transfer or sublicense the right to use the Account to third parties
  • Provide false information at registration or in communications with Dynami

8. Limitation of Liability

Dynami undertakes to ensure the full functionality and continuity of the Site and the App, but cannot guarantee they are free from errors or interruptions. Dynami shall not be liable for:

  • Malfunctions of the Site or the App due to force majeure, unforeseeable events, network failures, or scheduled maintenance
  • Data loss caused by technical malfunctions not attributable to Dynami
  • Content of third-party websites reachable through links on the Site or the App
  • Indirect, consequential, special, or punitive damages arising from the use or inability to use the Site or the App

Dynami's overall liability towards the User, for any reason whatsoever, shall in any case be limited to the amount paid by the User for the specific service that is the subject of the dispute in the last 12 months.

9. Sports Activities and Warnings

Dynami provides sports and wellness services intended for people in good health. Before starting any training programme, the User is advised to consult their physician, especially in the presence of particular health conditions, pre-existing pathologies, or aftermath of injuries.

Dynami declines all liability for injuries, physical damage, or adverse health consequences arising from the improper use of the sports services or from failure to follow the instructions given by the instructors. The User takes part in the sports activities at their own responsibility.

For activities involving the participation of minors, written consent from the parent or legal guardian is required. Dynami's services are in principle intended for adults, except for programmes specifically indicated as suitable for minors.

10. Privacy and Data Processing

The processing of Users' personal data is governed by Dynami Srl's Privacy Notice, available on the Site at the Privacy Policy page and in the App in the dedicated section. The Privacy Notice forms an integral part of these Terms. For information on the use of cookies, please refer to Dynami's Cookie Policy .

11. Applicable Law and Jurisdiction

These Terms are governed by Italian law. For any dispute arising from the interpretation, execution, or termination of these Terms, the competent court shall be that of the place of residence or domicile of the consumer User, pursuant to Art. 33 of Italian Legislative Decree 206/2005 (Consumer Code).

12. Changes to the Terms

Dynami reserves the right to amend these Terms at any time. Changes will be communicated to Users via publication on the Site and, where appropriate, by email to the registered address. The updated version of the Terms will fully replace the previous one from the date of publication. Continued use of the Site or the App following publication of the changes will constitute acceptance of the updated Terms.
